Henderson County District Attorney's report

District Attorney, Donna R. Bennett, reports the following Court activity for the week of January 1, 2007 through January 12, 2006:

*Katharine Ellen Harris, 46, of Chandler, pled guilty to the Third-Degree Felony Offense of Possession of Controlled Substance. The Court assessed punishment at ten (10) years confinement in the Texas Department of Criminal Justice, probated five (5) years, court costs, attorney fees, fine, restitution, theft management, A/A or N/A, urinalysis, obtain GED, $50 payment to Crime Stoppers, drug offender class, and a substance abuse evaluation and follow recommended treatment. The Court took into consideration one Burglary of Habitation when assessing punishment.

*Lorenzo Ituber Alamguer, 35, of Athens, pled true to all counts of the State's Motion to Revoke. The Court modified defendants to one hundred eighty (180) days confinement in the Henderson County Jail, daily A/A for 180 days, defendant's probation extended for three (3) years, and no alcohol at all at the defendant's residence.

*Christopher Leamo Payne, 31, of Mesquite, pled true to all counts of the State's Motion to Revoke. The Court assessed punishment at five (5) years confinement in the Texas Department of Criminal Justice, Institutional Division, previous court costs, attorney fees, fine and restitution.

*Doyle Glenn Holder, 45, of Kemp, pled true to all counts of both of the State's Motion to Revoke. The Court assessed punishment on one case at twelve (12) months confinement in the Texas Department of Criminal Justice, State Jail division, previous court costs, attorney fees, fine and restitution and three (3) years confinement in the Texas Department of Criminal Justice, Institutional division, previous court costs, attorney fees, fine and restitution on the second case.

*Gary Michael Benedetto, 23, of Houston, pled guilty to the Second-Degree Felony Offense of Possession of Controlled Substance. The Court assessed punishment at ten (10) years confinement in the Texas Department of Criminal Justice, probated seven (7) years, court costs, fine, restitution, A/A or N/A, urinalysis, 280 hours community service, $50 payment to Crime Stoppers, obtain GED, attend drug offender class and a substance abuse evaluation and follow recommended treatment.

*Guy Louis Byrd, 45, of Terrell, pled guilty to the State Jail Felony Offense of Fraudulent Use of Identifying Information. The Court assessed punishment at two (2) years confinement in the Texas Department of Criminal Justice, probated five (5) years, court costs, attorney fees, restitution, urinalysis, 240 hours community service, obtain GED, $50 payment to Crime Stoppers, and Substance abuse evaluation and follow recommended treatment. The Court took into consideration one Fraudulent Use of Identifying Information when assessing punishment.

*Jesse Ascencion Smalley, 32, of Athens, pled guilty to the Second-Degree Felony Offense of Possession of Controlled Substance. The Court assessed punishment at ten (10) years confinement in the Texas Department of Criminal Justice, probated seven (7) years, court costs, fine, restitution, A/A or N/A, urinalysis, 280 hours community service, $50 payment to Crime Stoppers, obtain GED, attend drug offender class and a substance abuse evaluation and follow recommended treatment.

*Stefani Patrice Hogue, 18, of Athens, pled guilty to the Second-Degree Felony Offense of Burglary of Habitation. The Court assessed punishment at seven (7) years deferred adjudication probation, court costs, attorney fees, fine, restitution, urinalysis, 280 hours community service, obtain GED, do not communicate with co-defendant, victim or victim's family, $50 payment to Crime Stoppers, attend the Theft Management Class, and a substance abuse evaluation and follow recommended treatment.

*Raymond Charles Bagley, 44, of Frankston, pled guilty to the Third-Degree Felony Offense of Possession of Controlled Substance. The Court assessed punishment at eight (8) years deferred adjudication probation, court costs, fine, restitution, urinalysis, 220 hours community service, obtain GED, $50 payment to Crime Stoppers, attend the Drug Offender Class, and a substance abuse evaluation and follow recommended treatment.

*Anitra Dian Weese, 31, of Kemp, pled guilty to the Second-Degree Felony Offense of Possession of Controlled Substance. The Court assessed punishment at ten (10) years confinement in the Texas Department of Criminal Justice, probated five (5) years, court costs, attorney fees, fine, restitution, A/A or N/A, urinalysis, 280 hours community service, obtain GED, do not communicate with co-defendants, out patient drug treatment program and a substance abuse evaluation and follow recommended treatment.

*Calvin L. Childers, 48, of Kemp, pled guilty to the State Jail Felony Offense of Possession of Controlled Substance. The Court assessed punishment at three (3) years Deferred Adjudication Probation, court costs, attorney fees, fine, restitution, A/A or N/A, urinalysis, 220 hours community service, obtain GED, $50 payment to Crime Stoppers, and a substance abuse evaluation and follow recommended treatment.

*Barbie Jean Gantt, 39, of Shreveport, LA, pled true to all counts of the State's Motion to Revoke. The Court assessed punishment at three (3) years confinement in the Texas Department of Criminal Justice, Institutional Division, previous court costs, attorney fees, fine and restitution. The Court took into consider- ation one Possession of Controlled Substance case when assessing punishment.

*Arthur Preston Mowery, Jr., 38, of Tyler, pled guilty to the 2nd degree Felony Offense of Burglary of Habitation. The court assessed punishment at five (5) years confinement in the Texas Department of Criminal Justice, probated five (5) years, court costs, attorney fees, restitution, A/A or N/ A, urinalysis, 300 hours community service, obtain GED, $50 payment to Crime Stoppers, theft management, and a substance abuse evaluation and follow recommended treatment.

*Linda Jane Chase, 42, of Gun Barrel City, pled true to all counts of the State's Motion to Revoke. The Court assessed punishment at eight (8) months confinement in the Texas Department of Criminal Justice, State Jail Division, previous court costs, attorney fees, fine and restitution.

*Chase Matthew Caddell, 18, of Gun Barrel City, pled true to all counts of the State's Motion to Proceed. The Court assessed punishment at ten (10) months confinement in the Texas Department of Criminal Justice, State Jail Division, previous court costs, attorney fees, fine and restitution.

*Joshua Don Stephens, 25, of Dallas, pled guilty to the Lesser Included Offense of Class A Misdemeanor Driving While Intoxicated. The Court assessed punishment at three hundred sixty five (365) days confinement in the Henderson County Jail, court costs and attorney fees.

*Scott Edward Hartgrove, 45, of Kemp, pled guilty to the Lesser Included Offense of Class A Misdemeanor Theft Over $500. The Court assessed punishment at forty two (42) days confinement in the Henderson County Jail, court costs, attorney fees, and restitution.

*Traci Embrey Hoffman, 34, of Athens, pled guilty to the State Jail Felony Offense of Theft Over $1500. The Court assessed punishment at three (3) years Deferred Adjudication Probation, fine, restitution, urinalysis, 300 hours community service, obtain GED, do not communicate with victim, $50 payment to Crime Stoppers, attend Theft management, and a substance abuse evaluation and follow treatment. The Court took into consideration one Theft Over $1500 when assessing punishment.

*Jesus Bertran Rodriguez, 43, of Athens, pled guilty to the State Jail Felony offense of Driving While Intoxicated with Child Passenger. The Court assessed punishment at three (3) years Deferred Adjudication Probation, fine, A/A or N/A, urinalysis, 300 hours community service, attend a Victim Impact Plane, Interlock device for ‰ term, alcohol awareness program, obtain GED, $50 payment to Crime Stoppers, and a substance abuse evaluation and follow treatment.

*Adan Lomas Rangel, 21, of Fort Worth, pled guilty to the State Jail Felony Offense of Criminal Mischief Over $1,500. The Court assessed punishment at two (2) years confinement in the Texas Department of Criminal Justice probated five (5) years, court costs, attorney fees, restitution, A/A or N/A, urinalysis, 240 hours community service, obtain GED, do not communicate with victim or co-defendant, attend Theft management Class, youthful offender program, and a substance abuse evaluation and follow recommended treatment.

*Abel Castillo, 28, of Athens, pled guilty to the Third- Degree Felony Offense of Evading Arrest. The Court assessed punishment at two (2) years confinement in the Texas Department of Criminal Justice, probated four (4) years, court costs, fine, urinalysis, ten (10) days confinement in the Henderson County Jail, 240 hours community service, obtain GED, $50 payment to Crime Stoppers, and a substance abuse evaluation and follow recommended treatment. The Court took into consideration one Endangering a Child when assessing punishment.
