Sheriff's Report

Sheriff Ray Nutt Sheriff Ray Nutt * On Monday, June 29, 2009, the Henderson County Sheriff's Department received several reports of missing jet skis. The reports came from numerous callers in the Cherokee Shores sub-division off SH 198 in Payne Springs. Deputy Josh Rickman responded and while investigating the reports the missing jet skis were located in a cove of Cedar Creek Lake just offshore.

During this same time the Sheriff's Department received a report of suspicious activity concerning three young males pushing a 4-wheeler down the street in Cherokee Shores; further investigation determined the 4-wheeler to be stolen.

Patrol Deputies Billy Jack Valentine and Sergeant Mitch Baker responded and detained three suspects, one adult and two juveniles, who were in possession of the 4-wheeler and a stolen gokart.

During this investigation Deputies and Investigator Kalon Rollins determined that the suspects were also involved in the unauthorized use of several Personal Water Crafts (Jet Skis) that had been reported earlier that morning. While interviewing suspects, information was learned concerning an earlier reported burglary of a residence on Coahoma St. in Cherokee Shores. Two additional suspects were identified, one adult male and one juvenile male who were found in possession of stolen property from that burglary.

At this time two 4- wheelers, 1 go-kart, 6 jet skis, and several items from the residential burglary were recovered, totaling in amounts over $20,000.00. Information concerning the adult suspects in these cases will be released at a later time due to investigative purposes.

* On Saturday, June 27, 2009 at approximately 10:45 pm, Deputies Richard Miller, Ronny Snow and Josh Rickman, along with District Attorney's Investigator Baldemar Quintanilla responded to a shooting on Kokomo St. in the Cherokee Shores subdivision. Officers located Nicole Montana, 29, who had been shot by her father, Gary Payne.

Investigator Bryan Tower and Henderson County Sheriff 's Office Command Staff were called to the scene. Investigators learned the following: an argument between Montana and Payne had taken place and escalated; Payne left his daughter's residence and went to his residence next door. Payne returned with a 12-gauge shotgun and began firing toward Nicole, striking her in the leg and foot.

Sheriff Nutt called out the HCSO Tactical Team. The tactical team made entry into the victim's house and located the suspect inside. He was taken into custody without incident.

The victim was transported to ETMC in Gun Barrel City and then to ETMC Tyler via helicopter. Gary Wayne Payne, 59, was arrested and booked for Aggravated Assault with a Deadly Weapon. Payne is currently being held in the Henderson County Detention Center under a $75,000 bond set by Justice of the Peace Pct. 4, Sue Tarrant.

At the time of this release, the victim has been released from the hospital.

Supervisors on the scene were Sheriff Ray Nutt, Chief Deputy Dan Parker, Major Kevin Hanes and Captain Kay Langford.

* On July 1, 2009, Henderson County Drug Enforcement Unit Investigators Ronny Halbert, David Faught, Darrell Waller and Kenneth Collard received an anonymous call advising a white male in a blue Blazer with a broken-out back glass was selling drugs at the Valero station at the intersection of SH 31 and FM 2495 in Athens. Investigators responded to the call and observed a white male matching the description given, standing in front of the blue Blazer.

Investigaztors approached the white male and identified him as Bill Monday. During investigation, Monday, 24 years of age, surrendered a black zipper bag containing a quantity of suspected methamphetamine, baggies and a spoon used to package the illegal narcotics. Investigators also obtained consent to search the vehicle and located a set of digital scales used to measure the suspected narcotics while packaging for distribution.

Monday was arrested and transported to Henderson County Justice Center charged with Possession of a Controlled Substance pg>1<4 grams. No bail has been set at this time.

* On July 1, 2009 the Henderson County Drug Enforcement Unit executed a search warrant in the 600 block of York St. in Athens. Investigators located a quantity of marijuana at the location during the investigation.

Brenda Faye Donnell, 44 years of age, was arrested and charged with Possession of Marijuana and transported to the HCSO jail. The investigation is ongoing and more charges could be filed.

Henderson County Drug Enforcement Investigators Ronny Halbert, David Faught, Kenny Collard, and Darrell Waller were involved in the investigation.

* On July 2, 2009, Henderson County Drug Enforcement Unit Investigators Kenny Collard, Ronny Halbert, Darrell Waller, and David Faught executed a search warrant issued by Justice of the Peace precinct 6 Milton Adams at a residence on Sands Ranch Road in Seven Points, Texas.

Upon arrival investigators observed a white male run from the location into a wooded area behind the residence. He was apprehended after a short foot chase and identified as Jerry Lee Culver, W/M, born April 8, 1982. Also present and located inside the residence were Zachary Keith Henderson, W/M, born August 19, 1977; and Alicia Joette Franks, W/F, born July 20, 1968.

All three subjects were transported to Henderson County Justice Center.
